汽车买卖中有关法律

摘要：随着社会经济的快速发展，汽车已成为当今社会的主要道路运行工具，人们对汽车的需求增加导致二手汽车交易日趋活跃。而由于我国汽车市场受旧的政策和管理模式的影响，使汽车交易十分混乱，随之诉诸法院的案件也不断增多。如何处理此类案件，在法律界始终众说纷纭。笔者结合自己承办的案件，提出了在汽车交易中所存在的六个方面的法律问题，经逐一探讨后，作出如下观点：一、汽车买卖办理过户手续不是买卖合同生效的必备条件，不能因未办理过户手续就认定买卖合同无效；二、汽车买卖中物的占有与物权登记相冲突时，应根据登记所具有的物权公示效力及公信效力，保护善意第三人利益；三、汽车买卖未过户的产权归属，应具体分析物权变动和债权平等性问题，存在于同一标的上的物权效力先于债权；四、关于承包经营中的汽车买卖关系，从订立合同的目的、性质、内容和相关法律、法规的规定等方面分析，此类承包经营合同依法成立；五、汽车牌照是市场经济的产物，具有价值，可以转让；六、对于认定未过户的汽车交通事故赔偿责任主体，不应依据车辆所有权的归属来确定，应确认运行支配和运行利益的归属者为赔偿责任的主体。全文共约8000字。

AccordingtosomecasesthatIexperienced,therearelegalproblemsthatexistincarsdealing.Afterstudyingthemonebyone,Ipresentthefollowingopinions.

1.Transferringproceduresarenottheessentialconditionsofbecomingeffectiveofcontracts.Neverconsideritineffectivebecauseofnottransferring.

2.Incaseofconflictofwhoownsthingsandwhohastherighttoregisterincarsdealing,weshouldprotectthethirdperson’sinterestoutofgoodwill,accordingtoeffectiveproofs.

3.Abouttheownershipoftheuntransferredcars,weshouldpracticallyanalyzetheproblemsofthechangeofownershipandequalityofcreditors’rights,andtheeffectofownershipshouldbefavoredovercreditors’rightsifonthesameconditions.

2.Carlicensesaretheresultofdealingineconomylife,sotheycanbetransferred.

3.Onjudgementaboutwhoshouldbemainlyresponsibleforthecompensatingforthetrafficaccidentofcarsthatarenottransferred,weshouldn’tjudgebytheownershipofcarsbutweshouldjudgebywhocanbenefitfromthemanagementofthecars.
