Goodmorning.Nextweek,theUnitedStatesSenatewillbegindebateonacotitutionalamendmentthatdefinesmarriageintheUnitedStatesastheunionofamanandwoman.OnMonday,Iwillmeetwithacoalitionofcommunityleaders,cotitutionalscholars,familyandcivicorganizatio,andreligiousleaders.They’reRepublica,Democrats,andindependentswho’vecometogethertosuortthisamendment.Today,IwanttoexplainwhyIsuorttheMarriageProtectionAmendment,andwhyI’murgingCongretopaitandsendittothestatesforratification.

Inourfreesociety,peoplehavetherighttochoosehowtheylivetheirlives.Andinafreesociety,decisioaboutsuchafundamentalsocialititutionasmarriageshouldbemadebythepeople--notbythecourts.TheAmericanpeoplehaveokenclearlyonthisiue,boththroughtheirrepresentativesandattheballotbox.In1996,CongrearovedtheDefeeofMarriageActbyoverwhelmingbipartisanmajoritiesinboththeHouseandSenate,andPresidentClintonsigneditintolaw.Andsincethen,votersin19stateshavearovedamendmentstotheirstatecotitutiothatprotectthetraditionaldefinitionofmarriage.Andtoday,45ofthe50stateshaveeitherastatecotitutionalamendmentorstatutedefiningmarriageastheunionofamanandawoman.Theseamendmentsandlawsexpreabroadcoeusinourcountryforprotectingtheititutionofmarriage.

Unfortunately,activistjudgesandsomelocalofficialshavemadeanaggreiveattempttoredefinemarriageinrecentyears.Since20__,statecourtsinWashington,California,Maryland,andNewYorkhaveoverturnedlawsprotectingmarriageinthosestates.AndinNebraska,afederaljudgeoverturnedastatecotitutionalamendmentbaingsame-sexmarriage.

ThesecourtdecisiocouldhaveanimpactonourwholeNation.TheDefeeofMarriageActdeclaresthatnostateisrequiredtoacceptanotherstate’sdefinitionofmarriage.Ifthatactisoverturnedbyactivistcourts,thenmarriagesrecognizedinonecityorstatemighthavetoberecognizedasmarriageseverywhereelse.ThatwouldmeanthateverystatewouldhavetorecognizemarriagesredefinedbyjudgesinMaachusettsorlocalofficialsinSanFrancisco,nomatterwhattheirownlawsorstatecotitutiosay.Thisnationalquestionrequiresanationalsolution,andonaniueofsuchprofoundimportance,thatsolutionshouldcomefromthepeople,notthecourts.

AnamendmenttotheCotitutionisnecearybecauseactivistcourtshaveleftourNationwithnootherchoice.ThecotitutionalamendmentthattheSenatewillcoidernextweekwouldfullyprotectmarriagefrombeingredefined,whileleavingstatelegislaturesfreetomaketheirownchoicesindefininglegalarrangementsotherthanmarriage.Acotitutionalamendmentisthemostdemocraticsolutiontothisiue,becauseitmustbearovedbytwo-thirdsoftheHouseandSenateandthenratifiedbythree-fourthsofthe50statelegislatures.
