Abstract： Article 1 of Criminal Law Amendment（ix）states the occupational ban system，based on the dualism of position，it is appropriate to identify occupational ban as security sanctions；application principle of professional prohibition can learn from suitable principle of Germany security sanctions as the theoretical guidance for the judge；the range of penalties stipulated in application conditions including detention and imprisonment， regulation is not applicable in principle，life imprisonment and death sentence with reprieve are generally not applicable，while fines applies to the unit exceptionally；Personality survey system can serve as a criteria for the judge to decide the necessity of professional prohibition. it should be declared after his sentence or parole，and the perpetrator should have the right to appeal.
